Georgia Tax: Tax Relief for Storm Victims

Were you affected by the severe weather that began in Georgia on March 14, 2008? If so, here is what you should know:

- Bartow, Burke, DeKalb, Floyd, Fulton, Jefferson and Polk Counties were declared a presidential disaster area by the federal government.

- The due date has been extended to May 19, 2008 for Georgia business and individual tax returns and payments normally due between March 14, 2008 and May 19, 2008 inclusively. These dates correspond with tax relief offered by the Internal Revenue Service.

- Business and individual taxpayers should write "March 2008 Tornado" across the top of forms eligible for the filing and payment extension. Taxpayers who file and/or pay electronically cannot make this designation and should follow the instructions below if they receive a late payment or late filing notice.

- The Georgia Department of Revenue processing systems automatically assess penalty and interest to returns and payments received after the statutory due date. Affected taxpayers who receive a penalty notice should call the telephone number on the notice to have any interest and/or penalties abated. They may also write "March 2008 Tornado" at the top of the notice and mail a copy to the address on the notice. Penalties or interest will be abated only for taxpayers who have an original or extended filing, payment or deposit due date from March 14 to May 19.

Taxpayers considered to be affected taxpayers eligible for the postponement of time to file returns, pay taxes and perform other time-sensitive acts include individuals who live, and businesses whose principal place of business is located, in the covered disaster area. Taxpayers not in the covered disaster area, but whose books, records, or tax professionals' offices are in the covered disaster area, are also entitled to relief. In addition, all relief workers affiliated with a recognized government or philanthropic organization assisting in the relief activities in the covered disaster area are eligible for relief.
